Webild Terms of Service

1. Overview

Welcome to Webild, an AI-powered website creation platform. These Terms govern your access to and use of our platform, websites, applications, and related services (collectively, the "Services").

By creating an account or using Webild, you agree to these Terms. If you do not agree, you may not use the Services.

2. Eligibility

You must be at least 16 years old to use Webild.

By using the Services, you represent that:

• You have legal capacity to enter into a binding agreement
• You are not restricted under applicable export or sanctions laws
• You will comply with all applicable laws

3. Account Registration

Accounts are created through Clerk authentication.

You are responsible for:

• Maintaining credential confidentiality
• All activity under your account
• Promptly reporting unauthorized access

Accounts may not be shared, resold, or transferred.

4. Services Overview

Webild enables users to:

• Generate and customize websites using AI
• Purchase and connect domains
• Host websites through Vercel
• Enable e-commerce via Stripe Connect
• Track analytics after domain connection
• Manage subscriptions and credits

5. Subscriptions, Credits & Billing

Payments are processed exclusively through Stripe.

Plans may be monthly or yearly and renew automatically unless canceled.

Credits:

• Reset each billing cycle
• Do not roll over
• Are non-refundable once consumed

Refunds are not provided once a billing cycle begins unless required by law.

You authorize Stripe to charge your payment method.

Taxes are calculated by Stripe based on your location.

6. Domains

Domains are purchased and managed via DNSimple.

Domain purchases are final and non-refundable.

If your subscription ends, you must transfer your domain within 15 days. After that period, Webild may release it.

Domain availability and DNS propagation are not guaranteed.

7. E-Commerce & Fulfillment Processing

a. Payment Processing

By enabling commerce, you agree to Stripe's Connected Account Agreement and Services Agreement.

Webild does not store customer card data.

b. Seller Responsibility

You are solely responsible for:

• Products and services
• Pricing and fulfillment
• Refunds
• Tax compliance
• Legal compliance

Webild acts only as a technology provider.

c. Chargebacks

Customer disputes are handled between you and Stripe. Webild is not a party to these transactions.

d. Prohibited Businesses

You may not sell products prohibited under Stripe's Restricted Business Policy.

We may suspend accounts engaged in prohibited commerce.

8. Inbox Integrations and Email Services

Webild allows users to connect third-party email accounts, including Gmail and Outlook, through OAuth authentication.

a. Authorization Scope

By connecting your inbox, you authorize Webild to:

• Access email content and metadata using read permissions
• Send emails on your behalf using send permissions
• Store OAuth access and refresh tokens for session continuity

b. Security & Storage

Webild:

• Does not store email passwords
• Does not persistently store full email bodies
• Does not download or store attachments
• Does not log outgoing email body content
• Does not analyze email content for advertising or AI training
• Does not track open rates or engagement metrics

Email content is rendered dynamically via provider APIs.

OAuth tokens are encrypted at rest and deleted upon disconnection or account deletion.

c. Disconnection

Users may disconnect inbox integrations at any time within account settings.

Upon disconnection:

• OAuth access and refresh tokens are permanently deleted
• Webild ceases all authorized inbox access

If a user deletes their Webild account:

• All associated OAuth tokens are removed
• Integration data is deleted within standard retention periods

d. User Responsibility

You are responsible for compliance with all applicable communication and anti-spam laws.

Webild acts solely as a technical intermediary.

9. AI-Generated Content

Webild uses AI to generate:

• Text
• Layouts
• Visual elements
• SEO structures

You acknowledge:

• AI outputs may contain inaccuracies
• You are responsible for reviewing content before publishing
• We do not guarantee originality

We do not use your data to train third-party AI models.

We may use anonymized and aggregated usage data to improve platform performance.

You may not use Webild to generate or host illegal or harmful content.

10. Ownership & Rights

You retain ownership of content you create.

You grant Webild a limited license to host, process, and display your content solely to provide the Services.

Webild retains ownership of:

• Platform code
• Design systems
• AI systems
• Infrastructure
• Branding

11. Analytics

Analytics activate once a domain is connected.

We may process site visits, engagement metrics, and conversion data within your dashboard.

Analytics data is visible only to the account holder.

12. Data Protection

All data is transmitted via HTTPS and stored using AES-256 encryption.

Infrastructure providers include Vercel, DNSimple, Stripe, and Clerk.

We comply with GDPR and CCPA requirements.

Users may request access, correction, or deletion of data by contacting admin@webild.io.

13. Acceptable Use

You may not:

• Violate laws
• Generate illegal or abusive content
• Attempt reverse engineering
• Circumvent usage limits
• Disrupt platform integrity

We reserve the right to suspend accounts for violations.

14. Branding

"Built with Webild" badge must be displayed on free tier sites.

Paid plans may remove the badge.

15. Service Availability

We do not guarantee uninterrupted service.

We are not liable for downtime caused by third-party providers.

16. Disclaimer of Warranties

The Services are provided "as is" and "as available."

We disclaim all warranties including merchantability and fitness for a particular purpose.

17. Limitation of Liability

Our total liability will not exceed the amount paid by you in the preceding 12 months.

We are not liable for indirect, incidental, or consequential damages.

18. Indemnification

You agree to indemnify Webild against claims arising from:

• Your content
• Your commerce activities
• Your email communications
• Your violation of law

19. Arbitration & Dispute Resolution

Disputes will be resolved through binding arbitration under Delaware law.

You waive the right to participate in class-action lawsuits.

20. Termination

You may terminate your account at any time.

We may suspend or terminate accounts for violations or abuse.

Upon termination, data may be deleted after a short retention period.

21. Changes to Terms

We may update these Terms periodically.

Continued use constitutes acceptance of revised Terms.
